Terms & Conditions of use

Welcome to WineSyndy.com ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website WineSyndy.com (the "Site") and any services provided therein, including the ability to enter into binding agreements. Please read them carefully.

By accessing or using our Site, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Site.

To be eligible for membership, you must: Be at least 18 years of age. Be a legal entity or an individual with the capacity to enter into a binding agreement. Agree to enter binding agreements for the purpose of purchasing wine.

We will need to occasionally send users notifications for various reasons, including, but not limited to: notifying users about further actions they are obligated to perform, notifying users of outstanding invoices, and sending order updates to users. At present, notifications are sent by email, therefore emails must be verified in order for the user to enter into agreements.

In certain cases, we may need to contact you to ensure the safe delivery of your product. In these instances, we may require your phone number to complete the delivery process. If your phone number has not yet been supplied, we may need to contact you via your verified email address to obtain your phone number, and we will update your profile with this information.

Members agree to: Act in good faith and only enter binding agreements that they fully intend to complete. When pledging for an allocation, this action enters you into a binding agreement, and members are obligated to fulfil their interest in the agreement. Pledge accordingly.

We reserve the right to refuse our service or deny any member the right to participate in any activities.

Members have the right to edit their requested allocation in their agreement until the point it has been fully-allocated, at which point a binding agreement is in place. Please refer to "Responsibilities of Members". WineSyndy.com reserves the right to discontinue an agreement. However, practically speaking we would only do this if there is insufficient interest.

We cannot guarantee:
1. that the condition of any wines will be perfect or at the peak of their drinking window.
2. that the condition of a wine is acceptable to your palate.
3. that the condition of the bottle, in any format, will be perfect; this includes the bottle, capsule, cork, label, and fill level.
We do our best to carefully select wines that are worth your time and space in your collection, and we only procure from trusted sources. When necessary, we scrutinise bottles for authenticity and storage conditions to help ensure the wines are still enjoyable.

We cannot offer voiding of invoices or refunds for binding agreements. Refer to section 5 "Responsibilities of Members". We cannot guarantee a refund, however, if the bottle you receive is legitimately in poor condition, not of your own fault, we will always strive to do what is right.

Discount codes can be made available for registered users of the Site. Users must comply with all applicable laws and regulations.
a. Single discount code use per purchase: Only one discount code can be applied per purchase. In the event multiple discount codes in a single transaction are found to be used, the transaction will be voided (This should only happen in error).
b. Discount codes are subject to expiration dates and specific terms set forth at the time of issuance.
c. Discount codes can be deactivated without warning, but in most cases, this would only happen if they were being used improperly, in gross error, or for a gross error in the purchase amount calculation.
d. Limitation of Liability: WineSyndy is not responsible for any errors or omissions regarding discount codes. We shall not be liable for any losses or damages resulting from the use or inability to use a discount code.

Termination of accounts will be considered if the member has not participated in any pledges or agreements. If the member has previously participated in any pledges or agreements, then the account can be disabled. We reserve the right to retain any information regarding member's previous activities.

We may update our Terms & Conditions of Use from time to time. We will notify you of any material changes by posting the new terms on our Site and update the effective date. We encourage you to review this Privacy Policy periodically.

These terms and conditions shall be governed by and construed in accordance with the laws of Hong Kong.
